In a Chapter 13 bankruptcy, you will create a repayment plan to repay some or all of your debts over three to five years. Your secured creditors, such as your mortgage lender, must be repaid in full. Your unsecured creditors, such as credit card companies, may be repaid a fraction of what you owe them. Further, when you file Chapter 13, your creditors can no longer try to collect their debts. This is known as the automatic stay. Unlike a Chapter 7 bankruptcy, you do not stand to lose any assets.
