Chapter 13 Bankruptcy

For people who do not qualify for Chapter 7 bankruptcy based on their income, Chapter 13 bankruptcy is a proven way to break free of debt problems. Chapter 13 can also help if you are behind on your mortgage and want to keep your home. If you are considering filing for bankruptcy, it is vital to have a lawyer on your side who can efficiently and effectively navigate the process with you.

Consider Bailey & Gunderson. With three offices in the Cincinnati area, our Chapter 13 bankruptcy attorneys serve people in Hamilton, Clermont, Warren and Butler Counties in Ohio. In every bankruptcy matter, we are committed to delivering quality representation and attentive client service.

Your Guide Through The Chapter 13 Process

In a Chapter 13 bankruptcy, you will create a repayment plan to repay some or all of your debts over three to five years. Your secured creditors, such as your mortgage lender, must be repaid in full. Your unsecured creditors, such as credit card companies, may be repaid a fraction of what you owe them. Further, when you file Chapter 13, your creditors can no longer try to collect their debts. This is known as the automatic stay. Unlike a Chapter 7 bankruptcy, you do not stand to lose any assets.

We will work closely with you to develop a repayment plan that will help you become current on your mortgage or automobile loan and protect your assets from creditors.

Do You Have A Second Mortgage?

Chapter 13 can offer other forms of debt relief. For instance, if you have a second mortgage on your home, you may be able to remove the second mortgage in bankruptcy. This is known as lien stripping and can create significant value. Over our firm's history, we have filed more than 1,000 bankruptcy cases. We understand the ins and outs of the bankruptcy process and will confidently and effectively help you get the debt relief you need.
