Ohio law permits a grandparent to petition a court to seek a visitation order for a grandchild. Often, obtaining an order is necessary when a grandparent no longer has a good relationship with a child, or a grandparent’s child is deceased and the other parent of the grandchild refuses visitation.
It must be noted that a visitation order for a grandparent is not automatically granted by a court. The court shall review several factors required by law to determine if it is appropriate for the court to issue a visitation order to a grandparent. The wishes of the grandchild’s parent(s) are given great consideration by a court, but are not solely determinative of this issue. Obtaining an order for grandparent visitation involves consideration of many factors, and a grandparent would be wise to consult with an attorney prior to filing a petition with a court.
