One of the largest causes of anxiety when a divorce begins is not understanding the process. Even if your sibling or best friend has recently been through a divorce, you probably were not made aware of all of the legal procedures and emotional struggles that were part of their divorce action. To reduce the stress of not knowing what to expect, have a conversation with your attorney as he or she is the one who is guiding you through this process.

The following advice (see the picture accompanying this post) were given to divorcing parents before Minnesota Judge Michael Haas (now retired) in 1994.
All divorcing parents should take the time to read and consider the advice of Judge Haas. Judge Haas’ advice to the divorcing parents before him were so profound that he has been quoted in numerous publications and appellate decisions.
We should all be so wise as we determine the best interests of the children of divorcing parents.

A trial to resolve your marital disputes can be very expensive, and few people end up happy when they are paying more in legal fees than they are receiving from the divorce. You are better off settling out of court especially if you do not have children or have not been married very long. In these cases, a dissolution of marriage may be the best option. Be amenable to mediation and settlement to resolve marital disputes. However, after assessing the pros and cons of your case, and the economic impact of litigation, it may be necessary to resolve marital disputes by a trial before a court judge or magistrate. These cases typically involve children or parties with sufficient assets and/or income. I know this sounds complicated. The attorneys at Bailey & Gunderson can help you decide which option (mediation, settlement or litigation) is best for you.
Not every case or issue has to be litigated, but when litigation is necessary, we can help you prepare and present your issues in a professional manner to the court.
