What is a “trust”? A trust is the right to the beneficial enjoyment of property and assets of which legal title is held by another person or entity.

There are many different kinds of trusts that may have many different purposes such as:

1) Avoiding probate and simplifying the transfer of property and assets to heirs and beneficiaries;
2) Providing income to a spouse;
3) Providing a source for expenses for the education of children or grandchildren;
4) Protecting a beneficiary of a trust from his or her creditors; or
5) Benefiting a charity or the public good.

A trust’s distinguishing feature concerns the fiduciary relationship created under the trust in which one person (the trustee) is the holder of the legal title to the property held by the trust. The trustee is bound to keep or use the property for the benefit of another person (the beneficiary).

If your husband or wife is currently supporting you, consider updating your resume and improving your skill set by obtaining additional education or training before seeking a divorce.

Be aware that the court can impute income to you and may expect you to be working if your children are school aged and you are not of retirement age or disabled. Spousal support is not granted in every case and is dependent upon several factors that the court must consider by law. Typically, cases were the spouses have large differences of income and a long-term marriage are some of the primary factors in cases where spousal support is granted.

Don't pass away without a Last Will & Testament like Aretha Franklin. Have a Last Will & Testament prepared soon if you do not have one. If you have a Last Will & Testament, review it annually to make sure your wishes and intentions are clearly stated. Without a Last Will & Testament, the State decides how your assets are distributed and who is appointed to administer your estate.

Choosing whether to file a Chapter 7 or a Chapter 13 bankruptcy depends on many factors requiring the assistance of a qualified attorney. For example, an attorney can help you assess some of the following factors that must be considered when filing for bankruptcy:

a. Personal assets. A Chapter 7 bankruptcy involves the liquidation of assets although there are some exemptions available that will allow you to keep all (or most) of your assets. If there are assets that must be turned over to a bankruptcy trustee in a Chapter 7, a Chapter 13 bankruptcy will allow you to begin a repayment plan to retain those assets that otherwise would be lost in a Chapter 7 bankruptcy.

b. Nature of the debt. Credit card debt is typically dischargeable at the end of bankruptcy. A Chapter 7 bankruptcy may be desirable for people with mainly credit card debt while those with non-dischargeable debt, such as income taxes, may benefit from a Chapter 13 repayment plan.

c. Personal income level. Your income will determine whether you can file a Chapter 7 bankruptcy, or will have to pay some (or all) of your debt through a repayment plan in a Chapter 13 bankruptcy.

New child support laws in Ohio will be implemented soon. Ohio House Bill 366, which passed both houses of Ohio's legislature on June 7, 2018, updates Ohio's child support guidelines for the first time in over 25 years. The changes modify the child support calculations, child support tables, and healthcare coverage guidelines. The changes also implement new parenting time adjustments to child support orders.
